A deed title expresses the actual ownership of a property. Transferring the title of your deed into the name of the trust is part of the Trust funding process.

Funding a Trust simply means you will transfer ownership of the asset (in this case your deed) to the Trustee of the Trust.

Generally when retitling an asset it's written as Trustee Name, as Trustee of the Trust Name. If you have multiple trustees, this could be written as Trustee One Name and Trustee Two Name, as Trustees of the Trust Name.

Another good way to conceptualize Trust funding is to think of a box.

  • Signing & notarizing the Trust document is what assembles the box
  • You still have to put things into the box which is referred to as Trust funding
  • Your Trust document says what happens at death similar to writing “Give these things to my kids upon my passing” on the box with a Sharpie
